Jessica Alba is a serious actress with several films under her belt, like the Jessica Alba dancing film, the Jessica Alba swimsuit film, the Jessica Alba stripper film and the Jessica Alba skintight superhero film.
Despite obviously being a very staid, dignified actress who never lets audiences judge her physical merits before her acting skill, it seems as if some people only want to discuss Jessica Alba’s naked body. People like the team at Playboy magazine, who Jessica is threatening to sue for putting a photo of her on the magazine’s cover without her permission.
If ever there was an actress who the term Made For TV Erotic
Thriller Star Of The Year 2010 applied to, it would be Jessica Alba (DVDs).
She’s always making slightly ropey films with the USP of featuring
Jessica Alba’s belly button and jiggly bum. And, for now, it’s a tactic
that seems to be paying off; after all, all the men on the internet want Jessica Alba to be their girlfriend – and, boy, do those men who hang out online all day ever have high standards.
However, all this male attention seems to be having some unwanted
consequences for young Jessica. Like the fact that Playboy magazine
stuck a giant photo of her on the cover of its March issue without
asking her. As a result, Alba is threatening to sue the publication for
causing her career "immeasurable harm" by giving the impression that
she’s in the magazine with her lady-bazzers out. Which she isn’t.
According to reports, Playboy approached Jessica Alba to feature in
an article on Hollywood’s 25 sexiest celebrities, but she rejected the
magazine’s advances flat out, and refused permission for Playboy to use
any pictures of her at all. At that point, her lawyers allege, Playboy
obtained a publicity photo of Alba under false pretences and slapped it
on the cover anyway.
As a result, the Jessica Alba’s legal team have hit Playboy with a
cease and desist warning, and are asking for all the profits of the
March edition as well as an undisclosed monetary settlement. In the
letter to Playboy, Alba’s lawyers reportedly state:
"In featuring
Ms. Alba’s photograph on the cover of Playboy’s March issue, it is
clear that Playboy’s intent was to create a false belief and/or
expectation among the public that Ms. Alba voluntarily appeared in the
nude, or semi-nude and that a revealing pictorial of her contained in
Playboy’s March issue."
You see? Jessica Alba cares about her fans.
She doesn’t want them to buy a copy of Playboy full of fake expectation that
it’ll be full of nude pictures of Jessica for them to have a crafty
shuffle to. Instead, fans are recommended to rent Into The Blue on DVD
and watch it all frame by frame as they relentlessly pump away at
themselves while imagining that Jessica is their pretty pretty wife.

I think it is a shame how society pressure young and maturer women to be shaplely and beautiful. Then they want to ridicule, harass, and exploit them for being beautiful. give the girl a brake, she has a great body, she is young, her skin is taut, she is cute as can be. However it is just her time. She no prettier than the next hottie. Jennifer Love- hewitt, Jessica Simpson, Barbara Eden, Elizabeth Montgomery, J-Lo, Tia Carrera, Halle Berry, Tawny Katawn, Carmen Electra, all beautiful and shapely. Does hate these womens for their physical possesions, everybody gets their time in the spotlight. It is Jessica’s A. time, let her enjoy it.

You can’t possibly be serious about ripping her on this?
Yea, she’s sexy. Yea, she’s kind of just a piece of meat in every film she has done. Yea, she has trouble acting sometimes…
BUT…
If Playboy isn’t paying her and it is using her image on the cover, she is entitled to be pissed and recover monetary damages…
First of all, if she’s on the cover, sales WILL GO UP. If her image is being used to make sales go up on a product, she is entitled to some of the profits.
If Playboy used her image without asking, they should pay.
jaque ass says
yes, give the girl a brake,
don’t run over her with a car!
Dreamy Tutu says
I think it is a publicity stunt.

So is the article saying she’s naked in Into the Blue? Guess I will be renting that.

You’re right on one point, she’s beautiful and she has been exploiting her beauty for profit. But that is exactly why she should sue Playboy. The sales of any issue are certain to go up if they place her on the cover, and if she didn’t agree to it, and isn’t getting paid for it, she should certainly sue. Her beauty is hers to exploit, regardless of anyone’s personal feelings about it. I think it’s a superficial and temporal way to gain fame. I think it’s a guaranteed way to sink your career, because beauty fades. Without true talent and personality it’s very tough for any performer to maintain a successful career. But, even if it’s a shallow way to make a living, it’s her decision to make. It’s her livelihood and Playboy shouldn’t be permitted to use her money-making visage without her consent or without compensation.

Honestly folks, if you owned a store and your hottest selling item was stolen…you’d call the police right?
Regardless of whether or not this woman can act, her image is part of her “hottest selling item” and she has every right to direct who gets to benefit from her image.
In this case it’s Playboy who is benefitting by selling more copies of their magazine because this actress’ image is on the cover. They have no contract with the actress which gives them the right to use her image for profit, so she is absolutely right to sue them.
Drue says
This is pointless, her career is at an all time hight right now which means she will be featured in Playboy in less than 5 years anyway…as either 1)a foolish career move or 2)a last stab at saving a waning career.
So, why the fighting Jessica!?

If there’s an article that discusses anything Jessica Alba related within, I’d imagine Playboy falls under the ‘newsworthiness’ exception to the traditional right of publicity causes of action. Here’s a good secondary source overview on how First Amendment protected newsworthiness interacts with a commercial right of publicity: http://www.publaw.com/rightpriv.html

give the girl a ‘brake’?! i understand all the sensitivities but, jeez, shouldn’t it be ‘break’, as against ‘brake’? its definitely not a typo …

You know, this girl is the biggest fucking tease in America. She pulls so much shit like “Look how hot and dirty I am” then pulls it all back.
Just like when she signed up to play the character on Sin City then decided AFTER FILMING STARTED that she didn’t want to do the nude scenes. “Hey! Let’s ruin the entire continuity of a movie because you’re a dirty tease!”
Her unfortunate demise to some crappy arthouse movie where she’s nude all over in 5 years is too good for her.

Uhm, all these posts saying that just because Playboy’s sales are going to go up, that Alba should get money are way off base. Do you think that Star or National Enquirer any other gossip/rag magazine cuts a check to everybosy they put on their cover? They certainly don’t get their approval ahead of time, and their sales certainly go up based on the cover.
